Terms & Conditions (tb-artglass.com)
1) Agreement
These Terms and Conditions (“Terms”) govern your use of tb-artglass.com (“Site”) and the purchase of products and digital content offered through the Site. By placing an order, downloading digital content, or using the Site, you agree to these Terms.
2) Parties / Seller
The products and digital content are offered by Tatyana Boyarinova Pearsall, in collaboration with Nicholas Pearsall.
Payments may be processed through Jank Glass (the “Payment Processor”), including payments made via PayPal, Google Pay, WooCommerce checkout methods, and/or Zell, depending on the payment method selected at checkout.
3) Products and Digital Content
- Shipped Products: Glass art items shipped to you by a carrier.
- Digital Content: Downloadable tutorials and other electronically delivered materials.
Digital Content is delivered electronically and is distinct from shipped Products.
4) Ordering and Acceptance
When you place an order, you submit an offer to purchase the items in your cart. We may accept or decline your order. Acceptance may be confirmed by an order confirmation email and/or by shipment of Products and/or delivery of Digital Content.
5) Pricing and Payment
Prices are shown in the currency displayed at checkout and may include applicable taxes where required. Payment methods may include PayPal, Google Pay, WooCommerce checkout methods, and/or Zell (as available).
You authorize the selected payment method provider to process the transaction. Payment processing is handled by third-party providers and/or Jank Glass as applicable, and those providers may charge transaction fees or apply their own terms.
6) Taxes
You are responsible for any applicable taxes, duties, and customs fees imposed by your location, unless stated otherwise at checkout.
7) Shipping, Delivery Estimates, and Risk of Loss
We make commercially reasonable efforts to ship and deliver within the estimated timeframes shown on the Site or at checkout. Delivery dates are estimates and are not guaranteed.
For shipped Products, risk of loss and title pass to you in accordance with applicable law and the shipping arrangements for your order (including transfer upon delivery to the carrier for shipment or upon delivery to you, depending on your jurisdiction).
International shipments may be subject to customs inspection and delays. You are responsible for import-related charges.
8) Returns, Refunds, and Exchanges
Because glass art is fragile and may be unique:
Refunds after shipping begins. Refunds are typically not eligible after shipping begins unless we first assess that the item arrived damaged or defective (including review/assessment based on photos and/or inspection of the item).
Change-of-mind returns. Change-of-mind returns are not accepted once digital downloads are available or once shipping has started.
Damaged/defective items. If a Product arrives damaged or defective, contact us at borolime@tb-artglass.com within a reasonable time after delivery and include photos and order details. We will review and, where appropriate, offer a refund, replacement, or other remedy that we determine is appropriate under the circumstances and applicable law.
Digital Content. Refunds for downloadable digital content are not eligible once the download/access is provided, except where required by applicable law.
9) Digital Content Delivery, Access, and Expiration
After purchase, Digital Content is delivered electronically via a download link and/or within your account/order page (as applicable in WooCommerce). Download availability may expire after five (5) weeks from the date of purchase, unless a different period is shown at checkout or required by applicable law. You are responsible for accessing and storing your purchased Digital Content.
10) Digital Content License
Upon full payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Digital Content for personal, non-commercial use.
You agree that you will not:
- copy, distribute, sell, or share the Digital Content (or any substantial portion),
- use the Digital Content for commercial purposes,
- bypass, disable, or attempt to bypass security features or access controls.
All intellectual property rights in the Digital Content remain with Tatyana Boyarinova Pearsall and/or Nicholas Pearsall and their licensors.
11) Cancellations
For shipped Products, cancellation may not be possible once processing/shipping begins.
For Digital Content, cancellation may not be possible once digital delivery/download has begun or is available.
12) Customer Responsibilities
You agree to:
- provide accurate billing and shipping information,
- promptly check order confirmations and delivery details,
- maintain access to the email/account used for purchase and delivery of Digital Content.
13) Prohibited Use
You agree not to use the Site for any unlawful purpose, or in a way that interferes with the Site, compromises security, or infringes the rights of others.
14) Limitation of Liability
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, consequential, or punitive damages, and
- our total liability related to products or the Site will not exceed the amount you paid for the relevant order.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
15) Intellectual Property
The Site, its content, branding, and the Digital Content are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content except as expressly permitted by these Terms or as allowed by applicable law.
16) Privacy
Our collection and use of personal information are described in our Privacy Policy [link to your Privacy Policy page]. By using the Site, you agree to that Privacy Policy.
17) Changes to These Terms
We may update these Terms from time to time by posting the revised Terms on this page. The updated Terms take effect when posted. Continued use of the Site or placing orders after changes means you accept the updated Terms, subject to applicable law.

19) Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles. Disputes will be handled in the courts located in Arizona, unless your local consumer laws require otherwise.
